For Scheutz Ch. 6.

First, read 131-134 for the background on the Lindbergh kidnaping.

1. So how do the opening statement and direct examination work together to build a narrative?

2. What does she identify as the challenges of building a narrative from testimony?

3. How does the advice from trial advocacy manuals she presents on the bottom of 135 relate to what you have learned in other COM classes?

4.What is the relationship between the stories witnesses tell and the themes introduced in opening statements?  What can attorneys do to foster that relationship?

5. Distinguish these types of witnesses: primary, expert, records, occurrence, reputation.

6. How does the advice on ordering testimony she identifies on 140 relate to what you have learned in other COM classes?

7. What are the ways attorneys link testimony to exhibits and to other testimony?  Why is that desirable?

8. Put the prosecution direct examination strategies she identifies – definition, inferences, validation – in your own words.  Do the same for the defense direct examination strategies she identifies – redefinition and reconstruction.
